The
leader of the Indigenous People Of Biafra (IPOB) Nnamdi Kanu has asked a
Federal High Court in Abuja to discharge all charges against him.
In
his reply to an application by the prosecution on the availability of
witnesses, the defense counsel, Chuks Muoma said the prosecution has
failed to exercise its right to appeal.
He said the prosecution has
since the arrest of the defendants focused on stalling the case by
“rigmarolling” since its assumption. Muoma said Section 351 subsection 1
of the Administrative Criminal Justice Act (ACJA) allows that when a
case is called the defendant appears voluntarily in obedience to court
summons or is brought pursuant to a warrant. But he noted that the DSS
have only focused on persecuting the defendants rather than prosecuting
them.
He said his clients, since their arrest, have being detained
unlawfully against various court orders. “Let them bring their
witnesses, we are ready for trial, we are ready to hear them and we are
also ready to be heard,” Muoma said. Muoma also urged the court to make
an order restricting the agency from re-arresting the defendants for
this same charge or any other charges again
